AcewithFun is an educational technology platform providing interactive lessons, quizzes, coding and digital-skills activities, an AI tutor, and tools for schools, operated from Nigeria. 

For purposes of these Terms:

“AcewithFun”, “we,” “our,” or “us” refers to AcewithFun and its owners, affiliates, subsidiaries, successors, assigns, employees, contractors, and authorized representatives.

“Platform” means the AcewithFun website, web applications, mobile applications, learning management system, digital classrooms, APIs, and any associated technologies.

“Services” include all educational content, live classes, recorded lessons, AI-powered educational features, assessments, quizzes, coding activities, downloadable resources, certificates, parent dashboards, teacher dashboards, school services, and future educational offerings.

“User” means anyone who accesses or uses the Services.

“Parent” means a legal guardian or person legally responsible for a child using the Platform.

“Student” means a learner enrolled on the Platform.

“School” means any educational institution using AcewithFun through an institutional account.

“Content” includes videos, worksheets, quizzes, software, text, graphics, animations, illustrations, assessments, lesson plans, activities, AI-generated outputs, downloadable materials, code, audio, music, logos, trademarks, designs, and all educational materials available through the Services.

“AI” means Artificial Intelligence 

“AI Features” means educational tools that use artificial intelligence, machine learning, large language models, recommendation systems, automated tutoring, adaptive learning, intelligent feedback systems, image generation, content generation, and future AI technologies integrated into the Platform.

Users may access AcewithFun only if they meet the following requirements:

• Adults must be at least 18 years old.
• Children under 18 may only use the Platform with parental consent or through an authorized educational institution.
• Schools must ensure they possess all necessary permissions to create student accounts.
• Users must comply with all applicable laws and regulations.

AcewithFun reserves the right to deny or terminate access where eligibility requirements are not met.

Users may be required to register an account before accessing certain Services.

Users agree to:

• provide accurate information;
• maintain current information;
• keep login credentials confidential;
• immediately report unauthorized access;
• accept responsibility for all activity under their account.

AcewithFun may suspend accounts created using false information.

We may require verification of identity where appropriate.

Because AcewithFun primarily serves children aged 3–13, special protections apply.

Parents are responsible for:

• supervising children’s use of the Platform;
• ensuring age-appropriate usage;
• reviewing AI-generated content where necessary;
• monitoring screen time;
• safeguarding login credentials.

Students agree to:

• use respectful language;
• avoid bullying;
• refrain from cheating;
• respect intellectual property;
• avoid sharing harmful or inappropriate content.

Parents may:

• manage subscriptions;
• monitor progress;
• request deletion of student data where legally permissible;
• modify permissions where available.

Schools may purchase institutional access for teachers and students.

Schools represent and warrant that they:

• possess authority to create accounts for students;
• have obtained any legally required parental permissions;
• comply with applicable child privacy laws;
• maintain appropriate data security practices.

Schools are responsible for:

• managing teacher accounts;
• managing student access;
• ensuring appropriate classroom supervision;
• safeguarding account credentials.

AcewithFun may provide:

• classroom dashboards;
• analytics;
• reporting;
• assignment tools;
• AI-assisted teaching resources;
• future institutional services.

Institutional subscriptions may be governed by separate agreements.

AcewithFun provides educational services designed to help parents and schools raise future-ready children .

Services may include:

• video lessons;
• interactive learning;
• quizzes;
• coding activities;
• AI literacy lessons;
• assessments;
• certificates;
• homework;
• teacher resources;
• classroom management tools;
• downloadable worksheets;
• educational games;
• live instruction;
• recorded instruction;
• adaptive learning;
• AI tutoring;
• future educational technologies.

We continually improve the Platform.

Services may be modified, expanded, discontinued, replaced, or updated at any time.

We do not guarantee that every feature will always remain available.

AI Features are intended to assist—not replace—human learning, teachers, parents, or professional educators.

Users acknowledge that AI-generated responses:

• may contain inaccuracies;

• may become outdated;

• may reflect incomplete information;

• should be independently reviewed where appropriate;

• should not be relied upon as professional advice.

Parents and teachers remain responsible for supervising educational decisions.

AI-generated content is provided “as is.”

AcewithFun may continuously improve, replace, or discontinue AI models.

AI capabilities may include:

• intelligent tutoring;

• personalized learning recommendations;

• adaptive lesson generation;

• automated feedback;

• educational chat assistants;

• speech recognition;

• image generation;

• code assistance;

• curriculum personalization.

These capabilities may evolve over time.

All intellectual property rights remain the exclusive property of AcewithFun or its licensors.

Protected materials include:

• curriculum;
• lesson plans;
• educational videos;
• worksheets;
• assessments;
• software;
• AI systems;
• logos;
• branding;
• animations;
• illustrations;
• graphics;
• characters
• coding projects;
• music;
• documentation;
• databases;
• website design.

Users receive a limited, non-exclusive, revocable, non-transferable license solely for personal educational use.

Users may not:

• copy;
• reproduce;
• sell;
• sublicense;
• reverse engineer;
• scrape;
• redistribute;
• publicly display;
• commercially exploit;
• create derivative works from Platform content without written permission.

Nothing in these Terms transfers ownership of intellectual property.

Users may upload:

• assignments;
• projects;
• code;
• artwork;
• written work;
• audio;
• videos;
• discussion posts;
• feedback.

Users retain ownership of their original content.

By uploading content, users grant AcewithFun a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify where technically necessary, distribute, and use such content solely for operating, maintaining, improving, securing, and delivering the Services.

Users represent that uploaded materials:

• do not infringe third-party rights;
• are lawful;
• are appropriate for children;
• are free of malicious software.

AcewithFun may remove content violating these Terms.

Certain Services require payment.

Prices are displayed before purchase.

Subscriptions may renew automatically unless cancelled.

Users authorize AcewithFun or its payment processors to charge applicable fees.

Unless otherwise required by law:

• completed purchases of digital content may be non-refundable once access has been granted;
• subscription cancellations take effect at the end of the current billing period;
• promotional offers may have separate terms;
• taxes may apply depending on jurisdiction.

Refund requests will be considered in accordance with AcewithFun’s Refund Policy.

We rely on trusted third parties to run the Platform, including cloud hosting and AI from Google (Firebase and Gemini) and payment processing from Paystack and Flutterwave. Your use of those features may also be subject to the third party's own terms.

AcewithFun strives to provide reliable Services.

However, uninterrupted availability cannot be guaranteed.

Services may occasionally be unavailable due to:

• maintenance;
• upgrades;
• cybersecurity events;
• internet failures;
• cloud provider outages;
• third-party service disruptions;
• force majeure events.

AcewithFun is not liable for temporary interruptions.

We may offer a referral program allowing you to earn points or rewards for introducing new users. 

Rewards are subject to the program rules shown in-app, must not be obtained through fraud or self-referral, and may be adjusted, withheld, or withdrawn where abuse is detected. 

Rewards are offered only once for each user or school introduced to AcewithFun.

We may change or end the program at any time

AcewithFun implements reasonable administrative, technical, and organizational safeguards designed to protect user information.

Users are responsible for:

• maintaining password confidentiality;
• using secure devices;
• notifying AcewithFun of unauthorized access.

No internet transmission or electronic storage system is completely secure.

Accordingly, absolute security cannot be guaranteed.

Except where prohibited by law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis.

AcewithFun disclaims all warranties, including implied warranties of:

• merchantability;
• fitness for a particular purpose;
• non-infringement;
• uninterrupted operation;
• accuracy;
• reliability.

We do not guarantee:

• examination success;
• admission outcomes;
• employment;
• academic performance;
• AI accuracy;
• uninterrupted availability.

To the fullest extent permitted by law, AcewithFun shall not be liable for any:

• indirect damages;
• consequential damages;
• incidental damages;
• special damages;
• punitive damages;
• loss of profits;
• loss of goodwill;
• loss of data;
• business interruption.

Where liability cannot legally be excluded, AcewithFun’s total liability shall not exceed the amount paid by the user for Services during the three (3) months preceding the event giving rise to the claim.

Users agree to defend, indemnify, and hold harmless AcewithFun and its directors, officers, employees, contractors, affiliates, licensors, successors, and agents from any claims, liabilities, losses, damages, judgments, settlements, costs, or expenses (including reasonable legal fees) arising out of or related to:

● violation of these Terms;

● misuse of the Services;

● infringement of intellectual property rights;

● unlawful conduct;

● content uploaded by the user;

● breach of applicable laws.

AcewithFun may suspend or terminate access immediately if:

● these Terms are violated;

● fraudulent activity is suspected;

● illegal conduct occurs;

● platform security is threatened;

● required fees remain unpaid;

● abuse of staff or other users occurs.

Users may terminate their accounts at any time, subject to any outstanding contractual obligations.

Termination does not affect rights or obligations accrued before termination.

Certain provisions, including intellectual property, indemnification, limitation of liability, dispute resolution, governing law, and confidentiality obligations, survive termination.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continuing to use the Platform after changes take effect means you accept the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of laws principles.

Nothing in these Terms limits any mandatory consumer rights available under applicable law.

The parties agree to first attempt to resolve disputes through good-faith negotiations.

If a dispute cannot be resolved informally within thirty (30) days, the parties may agree to mediation before commencing legal proceedings.

Where mediation is unsuccessful or unavailable, disputes shall be submitted to the courts of competent jurisdiction in Nigeria, unless a separate written agreement provides otherwise.

Nothing prevents either party from seeking urgent injunctive or equitable relief where necessary to protect intellectual property, confidential information, or other legal rights.

These Terms constitute the entire agreement between the parties regarding the Services.

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

AcewithFun’s failure to enforce any provision shall not constitute a waiver of that provision.

Users may not assign their rights or obligations under these Terms without AcewithFun’s prior written consent.

AcewithFun may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, financing transaction, or by operation of law.

Headings are provided for convenience only and do not affect interpretation.

Electronic acceptance of these Terms has the same force and effect as a handwritten signature where permitted by law.

AcewithFun may amend these Terms from time to time. Material changes will be communicated through appropriate channels, and continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms
